A Utah state court has dismissed a lawsuit EnergySolutions filed against Kurion over one of its waste treatment technologies, but the legal battle appears to be far from over. EnergySolutions sued Kurion earlier this year alleging that one of Kurion’s treatment methods for addressing radioactively contaminated water violated EnergySolutions’ intellectual property rights and sought an injunction against its use. In his Sept, 19 ruling granting Kurion’s motion to dismiss, Judge Paul Maughan said the Utah state court lacked jurisdiction for the case. Now, EnergySolutions appears set to try to pursue its legal case again in another venue. “EnergySolutions will vigorously protect its intellectual property rights in a suitable court,” company spokesman Mark Walker said in a written response late yesterday.
Kurion, though, continues to view EnergySolutions’ suit as “without merit,” CEO Bill Gallo said in a statement. “The dismissal of the suit is further evidence that this is a nuisance case that was contrived in an effort to slow Kurion’s momentum by a company that considers itself to be a competitor,” Gallo said.
