SOUTH CAROLINA DROPS MOX SUIT

South Carolina announced Friday it would drop its lawsuit against the Department of Energy after DOE last week said it would continue construction work on the Mixed Oxide Fuel Fabrication Facility through the end of the fiscal year, according to reports. South Carolina filed suit against DOE in March soon after the Department announced plans to put the project into “cold standby” immediately. The state claimed that the Department could not use FY’14 MOX construction funds to shut down the project without permission from Congress. The Department last week said it would wait until FY’15 to suspend the project. The state was pleased with that outcome and decided to drop the suit late last Friday, according to The State.
