The companies looking to trade ownership of Indian Point Energy Center can participate in a federal case against the transaction, a judge ruled Friday.
In an order dated April 9, a D.C. circuit court judge approved Entergy and Holtec International’s petition to join the case, filed Jan. 22 by the state of New York. The two companies submitted their request in February.
Any entities that want to participate on New York’s behalf have 14 days to file their own requests, the Friday filing said. No new petitions had been filed at deadline Monday for Weapons Complex Morning Briefing, according to the court docket.
New York’s suit challenges the sale of the Indian Point plant from Entergy to Holtec for decommissioning. The state has questioned Holtec’s financial ability to dismantle the Buchanan, N.Y., site safely. In particular, the suit raised concerns about the company’s use of Indian Point’s $2.1 billion decommissioning trust fund, which it received a federal exemption to use for non-decommissioning activities like site remediation and spent fuel management.
Holtec should take full responsibility for Indian Point some time this month, when Entergy wraps up operations at the plant’s Unit 3 reactor. It’s the last one at the three-reactor site to shut down — Unit 2 went offline late last year, and Unit 1 went dark back in 1974.
