Judge Blocks FBP from Hiring Pro2Serve Workers

A federal judge late last week blocked Fluor-B&W Portsmouth, LLC, from hiring employees of Professional Project Services (Pro2Serve) at the Portsmouth D&D project. The judge partially granted a request from Pro2Serve for a temporary restraining order as it moves forward in its recently filed lawsuit against FBP. Pro2Serve has accused FBP of seeking to violate a teaming arrangement and subcontract through a plan to descope some of Pro2Serve’s work at Portsmouth, as well as of attempting to poach Pro2Serve employees. In his order, the judge wrote that “Pro2Serve has demonstrated that absent an injunction, it will lose the valuable and uniquely qualified employees who are able to perform the work pursuant to the agreements, such that the continued viability of Pro2Serve and its ability to continue to provide the unique services for which it contracted will be in jeopardy.” FBP declined to comment on the issue this week.
